The Seperation of Powers and the Power Structure of Washington State Government

Separation of powers refers to the division of government responsibilities into distinct branches to limit any one branch from exercising the core functions of another. The intent is to prevent the concentration of power and provide for checks and balances.

Forty state constitutions specify that government be divided into three branches: legislative, executive and judicial. The powers of state government are legislative, executive, and judicial. Persons charged with the exercise of one power may not exercise either of the others except as permitted by this Constitution.

OK, so let's see who's running this State.

The Judicial Branch, All Lawyers. Check

The Executive Branch, A Lawyer (Former AG). Check

The Legislature, the House and the Lobbyists, mostly Lawyers. Check.

The Commission on Judicial Conduct (the only oversight and accountability for judges). All Attorneys, judges or appointed by the Executive Branch Attorney. Check

Are the lines looking just a little blurry at this point? Draw your own conclusion.

Check Mate. Goodbye Justice . . . Goodnight America. No, this is not America.

When the whole system is corrupt, filing law suits is an exercise in futility

This is an interesting perspective from a former Communist Country ex-patriot sent in from Dejure . . .

Listen to this lady who lived under communist rule warn America about what is happening to our country:

"I was born in the former Soviet Union. I was born in a place called Kishinev, which is between Russia and Romania. And this is one of the reasons why I'm so passionate about it. I lived in a country that had no freedom of speech, that had no freedom of religion, that had no free press. I know how horrible it is, how people were trying to escape a communist country. And when I'm hearing speeches by Obama when he's saying that he wants to have an army of a million people, a civilian national security army -- this is scary. We have already an army. We already have police and sheriff's department and FBI. Why do we need it? Who those people are gonna be?"

http://drorly.blogspot.com/2008/12/when-whole-system-is-corrupt-filing-law.html

I guess I need to explain better where I am coming from. I have now some 10,000 e-mails with a lot of opinions in regards to different law suits, but let me explain myself by bringing an example. In the Soviet Union any and all law suits filed against the Communist party operatives and governmental officials always ended up in favor of the Communist party and the government. This wasn't because the lawyers for the people were incompetent and dumb, it happened because the system was corrupt to it's core and it reached a point when any law suit filed was an exercise in futility and the only thing that could bring any real change and sanity was an uprising, a revolution against the system, and that is why Leh Valensa and Solidarity got an overwhelming support of the people, that is why Wazlav Havel succeeded in Chech republic, that's why the Berlin wall fell. People despised the corrupt system that gave people no freedom of speech, no free press and no justice in the judiciary system.

Unfortunately, when I saw what is happenning in this country in the last year, I can see an eerie resemblence of what I saw in the Soviet union. We see a totally corrupt press that is manipulated by a few in power and we see a corrupt system of government. The facts of the case are unbelievably simple. According to Law of Nations, statements by the first chief Justice John Jay and framer of the 14th ammendment John Bingham "natural born citizen is one that was born in this countryy with parents that are citizens of this country". It cannot be more simple then that. Regardless of where Obama was born, he is not eligible. If he was born in Kenya, he is not only not eligible for presidency, but also not a citizen and needs to apply for his green card. The fact that nobody in the government is willing to do a thing about it and nobody in the judiciary is willing to hear the case on the merits, tells me that the whole system is totally corrupt and that is why I feel we need to go on the offensive. Filling law suits will not be enough. All the law suits will end up in the Supreme Court and if 6 out of 9 Supremes couldn't care less about the Constitution of this country, then we are wasting our time.

It is important to show each and every American, how corrupt our system is. We have to hold all of the judges and all of the elective officials accountable. We are showing the citizens of this country, how arrogant the government elite is, when after thousands of letters and petitions they do nothing. We show how aloof the judiciary is, when they are not willing to hear the cases on the merits.

Now let's take Trilateral commission and Bielderberg group. Why are those so universally despised by the people? Because these are closed, secretive societies. Naturally people are apprehensive of any cabals, any closed societies, they are fearful of their governments being taken by small groups of special interests that might be opposite to the interest of the populace. When people see that the top echelons of power in both Republican and Democratic party are being taken by reported members of such groups, when they see, how year after year their jobs are being shipped to the third world countries with labor costing pennies on the dollar, when they see Treasuries looted and as a final insult somebody totally ineligible pushed up in the White House, people are ready for revolt and rightfully so.

Our government and our judiciary need to understand, that they crossed all boundaries and they need to wake up. Let's take an example from medicine: when a parasite or a cancer enters a body of a host, it flourishes initially, but as it spreads, it gradually kills the host and ends up dying with the host.

If the groups like Trilateral commission and Bielderberg group don't want to be despised by the people, they need to open their doors to the media, and not only to their puppet media, but to free Internet reporters like me. They need to open their membership to the people, they need to show that they act in the interest of the people and not against the people.

The Judiciary needs to hear the cases on the merits and render judgements based on the Constitution and not the Judgements that de facto tear apart the Constituion.

The members of the Congress and the Senate need to announce to the people that they will demand the hearing on January the 8th, if Judiciary does not hear the case on the merits until then.

This used to be a great country, it has a lot of great people, and people in power need to rise to the occasion and show that they represent the interests of the people, or people will be justified in impeaching and recalling and finally replacing people in power.

CASA looking for a few good men?

The TC CASA program must be a little top heavy with left leaning minded volunteers. I would guess that they are looking for a few good conservative men. In the spirit of "diversity", isn't it time for a card carrying Republican to fill the next CASA or GAL slot? You know how much the TC court likes "diversity" and surely they recognize that in order to actually be "diverse" they might actually need somebody in the program with short hair that is actually of a different gender. Just wishful thinking perhaps. Imagine that, the family court team being a cross section of society.

Time to wake up and smell the coffee.

The 2008 Judicial "Elections" in Review

Let's take just a moment before heading into the new year of 2009 and review what we, as citizens, learned (if you were paying attention) . . .

1. 12 Attorneys ran for 1 "open" Judge Seat

2. Constitution smashing, socialist, activist Judges who routinely get overturned by the higher courts get re-appointed without a single challenger. Wickham, Casey, Pomeroy, and Mcphee had nobody run against them even though it was an open election. There were no challengers from the local Bar association.

3. The only conservative, rational judge in this county (Judge Tabor) was challenged by Ed Holm. Ed promised to be more "progressive" than Mr. Tabor. Mr. Holm even pointed out that he is a Democrat in a non-partisan election for a non-partisan position that is supposed to rule by law and he promised to legislate more Thurston liberalism from the bench. Fortunately, most people saw through the clown show. Ed was a former partner in Connolly, Tacon, Meserve-Szurszewski. So is Judge Mcphee.

4. Candidate Jamie Moore was being promoted by the two biggest anti-father/feminist law firms in the county; Connolly, Tacon, Meserve-Szurszewski, Mcphee, Holm and the "Women's" Law firm of Anne Redford-Hall. She was clearly the Lesbian mafia's first choice.

5. The election is a ruse and these judges are appointed by the political or governmental powers that be or by the Bar association or both. We, the people have no say about their courts.

6. Thurston County is obsessed with the DV scam and gravy train. The Prosecuting attorney's office loves the Joe Biden VAWA dollars and are hoping to expand the racket to include it's own little court called the Magic DV court. Ed Holm and Jodi Erickson-Mildrew are hoping to expand DV from a cottage industry into a much greater Thurston, Inc. revenue stream.

7. Women Judges are a shoe in here in Thurston County. Hirsch-Powers, Murphy-Williams.

8. There is still nothing more determinate in Hazzard county than being from here and being considered a Thurston Insider. Sam Meyer may make a fine judge. But, there is no way he is more qualified or possesses greater judicial qualities than Bill Gilbert.

From this you can draw your own conclusions about our beloved Hazzard County aka Thurston County, WA.

Some Sanity in the Crowded District Judicial Race

From a fellow liberty minded republican . . .

Regarding Greg Rosen and Bill Gilbert

1. Bill Gilbert knows the County's District and Superior courts well as his experience as a deputy prosecutor here and a defense lawyer give him the required knowledge and working of the District Court. He knows what works well and what doesn't. He wants to make a difference and that's why he's stepping up.

2. Bill Gilbert is endorsed by many crucial people at the Attorney General's office, i.e. those on the 7th floor where McKenna's office is located. These are the people whom McKenna hired. However, there are three strikes against Rosen I'd like you to know:

a. Greg Rosen was hired by Gregoire.

b. He is supported by maybe a couple other career attorneys at the AG office, who are not known to have Republican type of commitment to the Constitution.

c. Greg Rosen is also one of the four endorsed by the Democratic Party. I would not trust his judicial philosophy.

Judicial Race should not be a Popularity Contest (A letter to the editor from a fellow republican)

The County’s District Court Judicial race seems to have degenerated into a popularity contest like electing other politicians. A massive endorsement list does not reflect the quality of a judicial candidate and should NOT be the criteria for voters’ decision. In fact, attorney is a profession which ally themselves more together than any other professions. When was the last time you hear a lawyer testifying against another for legal malpractice? Endorsements from other big legal names actually make me more suspicious of ‘collusion’ within the legal community.

Instead, I urge voters to cast your vote based on the candidate’s ability to make sound judicial judgments (jurisprudence), which is directly related to a candidate’s length of time as an attorney and variety of experience in various areas in the legal field.

A few big names in this race have relatively short experience as attorneys. Sam Meyer, who was endorsed by The Olympian and other big names in the field, has been an attorney for only 13 years. Likewise, Jodi Erickson-Muldrew has 13 years & Laura Murphy has only 8 years.

Bill Gilbert has over 20 years’ legal experience with variety as deputy prosecutors in two counties, pro tem judge in various capacities, and a business owner in private practice. His variety of experience at various levels and capacities in Thurston County courts lend him the most relevant insight into what voters deserve at the District Court.

District Court Judge candidate questionnaire in the Daily Oh

District Court Judge candidate questionnaire in the Daily Oh

"The court could also add to its rehabilitative courts by adding a Domestic Violence Court. This would address one of the most costly and time-intensive problems our community currently faces." - Jodi Erikson-Mildrew

Good Lord, how about you county judges just stop handing out POs and ROs like they are candy? Who the heck do you think is clogging up the courts with DV when you encourage women to lie and never hold them accountable? Perhaps some level of evidence being required and following due process and the law? Let's just give every vindictive woman who asks a PO. Just make sure she uses the words "as a woman", "scared" and be sure she throws a big ol' hissy fit.

The other candidates have some interesting comments, as well.
